User Agreement

General terms

This User Agreement (hereinafter referred to as the “Agreement”) extends to the relationship between ASBISK Enterprises PLC (a legal entity established and acting under the laws of the Republic of Cyprus, registration number HE 75069, registration address: 43 Koronakio St., Diamond Court, Diamond , 4103 Limassol, Cyprus, hereinafter - ASBISK) and the User of Canyon devices belonging to ASBISK.The Canyon device is a smart watch that provides the User with the opportunity to use them in accordance with the functionality (pedometer, pulse, pressure, saturation, etc.), including through a mobile phone (smartphone, tablet).ASBISK provides the User with the opportunity to use Canyon devices under the conditions set forth in this Agreement. Having started using the Canyon device, the User is considered to have accepted the terms of the Agreement in full, without any reservations or exceptions.The Agreement may be changed at any time by the ALIBRARY without notifying the User. The updated version of the Agreement is available to the User via a mobile phone (smartphone, tablet), as well as on the ASBISK website https://canyon.eu/watch-terms/This Agreement is governed by and interpreted in accordance with the laws of the Republic of Cyprus. All possible disputes arising from the relations governed by this Agreement shall be considered in court at the location of the ASCIB in the manner prescribed by applicable law.Any provisions of the Agreement that become prohibited or invalid in accordance with applicable law do not affect the validity and / or legal force of the rest of its provisions.

Technical and software features of the Canyon device

Technical and software characteristics of the Canyon device, as well as its functionality, are provided in each model of the distributed smart watches.ASBISK ensures the use of the Canyon device 24 hours a day, 7 days a week, except for cases when, due to technical or other reasons beyond the ISBISK, the use of the Canyon device becomes impossible. ASBISK does not guarantee proper operation of the Canyon device if it is used in a manner that does not meet the technical and software requirements for the current model of smart watches.The number of steps measured by the Canyon device may differ from the real indicators, as it depends on the total activity of the User, lifestyle, physical contact with the device and other factors. The sleep rates measured by Canyon devices may differ from the actual ones, because they depend on the user's physical contact with the device, activity during sleep and other factors.Canyon devices are not medical devices, respectively, indicators of pulse, pressure and saturation can not be used for medical purposes and be the basis for appropriate decisions and / or treatment. If it is necessary to consult and / or make decisions regarding health and / or treatment, the User should contact his doctor.The maximum brightness value of the screen of the device leads to a decrease in battery life. To save battery power, it is recommended to set the minimum comfortable screen brightness (for devices with screen brightness adjustment).To ensure that your activity history is kept daily (at the end of the day), you should synchronize your Canyon device with a mobile phone (smartphone, tablet) application.For the application to work and to communicate with Canyon devices, Bluetooth, geolocation (all sources) and data transfer must be enabled in the phone.

Additional device features

To gain access to additional functions of the Canyon device (tracking the location (geolocation) of a smart watch), provided that this model of the device supports such functions, the User should synchronize the Canyon device with the mobile phone application (smartphone, tablet) and also register with using a pair of login-password. After registration, the User has the right to activate access and start using additional functions of a smart watch in the amount and under the conditions established by this Agreement.When tracking the location of a Canyon device via the Internet, the User is recommended to use Google Chrome, Yandex Browser, Apple Safari, Mozilla FireFox and Internet Explorer browsers. ASBISK does not guarantee proper operation of the device when using other Internet browsers.ASBISK recommends using the screen resolution of a mobile phone (smartphone, tablet) above 1280 x 1024. ASBISK does not guarantee full display of data when using lower screen resolutions.The user is responsible for the security (resistance to guessing and hacking) of the password chosen by him, and also ensures the confidentiality of his password. The user is responsible for all actions / omissions, as well as their consequences, within or using a user account. ASBISK is not responsible for the loss or damage of User data, as well as other consequences that may arise due to the User’s failure to comply with the requirements of this clause.

Personal Information

In accordance with the General Data Protection Regulation (GDPR) No. 2016/679 of April 27, 2016, adopted by the European Parliament, the Council of the European Union and the European Commission, ASBISK processes the personal data of Users (name, email address, gender, country) provided during registration to synchronize the Canyon device with a mobile phone application (smartphone, tablet), and subsequent authorization.Any personal data provided by the User is protected. Access to personal data is restricted to persons specifically authorized by the ASCII. Cookies

Like most retail websites, ASBISK uses cookies, which are fragments of data provided to the User’s browser, which allow ASCHISK to identify the User when it accesses the ASCII system. When deleting your account, the User may not use the Portal and / or the Services as a registered User.To enter the personal account, the User authorizes only using the login / password pair provided to him.

No warranty, limitation of liability

ASBISK does not guarantee the accuracy, accuracy, completeness and relevance of the information posted by the User during registration for synchronization of the Canyon device with the mobile phone application (smartphone, laptop, tablet or personal computer), and subsequent authorization. The user must independently assess the risks associated with the use (inability to use) of the functions of the Canyon device, including when performing synchronization / authorization, for the consequences of such use, and is also liable to third parties for their actions / omissions.ASBISK is not liable and does not indemnify any losses caused to the User or third parties as a result of using or not using the functions, information and services available or received by the User using the Canyon device.ASBISK is not responsible for poor-quality Internet or Bluetooth connection of the User, as well as for improper operation of the Internet or service provider with which the User has entered into a service agreement.All questions and claims related to the use (inability to use) of the Canyon device, as well as possible violation of the rights and legitimate interests of the User and / or third parties caused by the use of the Canyon device, should be sent to ASBISK at the following address: Diamond Court, ul.
